Booking Terms and Conditions
The Wedding Travel Company is a trading name of Travelbugz Limited, a company incorporated in England and Wales (Company Number 04714191) with a main office in New York, NY, USA. The following Booking Terms and Conditions, together with our Privacy Policy and any other written information we brought to your attention before we confirmed your booking, govern your booking with us (collectively, “Booking Terms and Conditions”).The terms “we” “us” and “our” refer to The Wedding Travel Company, while references to “traveler”, “you” and “your” mean all persons named on the booking, including anyone subsequently added to or substituted on that booking. Please read the following terms herein carefully as they set out our respective rights and obligations. If you do not agree with any part of these Booking Terms and Conditions, you must not make a booking with us or pay us in connection with our travel-related services.
References to “Travel Arrangement(s)” in these Booking Terms and Conditions are to the accommodation, flights, transport, activities, excursions and other services we feature on our website. References to “Supplier” means the third party supplier of the Travel Arrangements including but not limited to accommodation providers, transfer providers, car hire companies, airlines, tour operators and attraction providers.
By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that he/she:
a. has read these Booking Terms and Conditions and has the authority to and does
agreed to be bound by them:
b. consents to our use of personal data in accordance with our Privacy Policy here and is authorized on behalf of all persons named on the booking to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements);
c. is of sufficient age to create binding legal obligations and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services;
d. accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.
Further, you agree that any violation of these Terms and Conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable Travel Arrangements.
Please Note: We act only as an agent in respect of all bookings we take and/or make on your behalf.
1. Your Contract
When making your booking we will arrange for you to enter into a contract with the applicable Supplier of the Travel Arrangements, as specified on your confirmation invoice. Your booking with us is subject to these Booking Terms and Conditions and the specific terms and conditions of the relevant Supplier(s) you contract with and you we advise you to read both carefully prior to booking. The Supplier’s terms and conditions may limit and/or exclude the Supplier’s liability to you.
Supplier’s terms and conditions:
Terms and conditions including tours operators, airlines and all other locals suppliers available upon request. Please speak to one of agents to request this.
Your booking is confirmed and a contract between you and the Supplier will exist when we send you confirmation on their behalf.
By clicking to book and entering both your personal and payment details on-line, you are requesting that we make a booking on your behalf with the relevant Supplier for your chosen Travel Arrangements. You will be bound by both our Booking Terms and Conditions and the relevant booking terms and conditions of the Supplier/ Principal, and so we advise you to read these very carefully prior to booking.
It is important to note that your payment at the time of making your booking does not in itself mean that your booking is confirmed, as all bookings are subject to availability, and we do not guarantee that any of the Travel Arrangements advertised will still be available at the time of booking.
In order to confirm your booking we have to make live reservations with the Suppliers, and as such we have to have the security that we have the appropriate payment from you. Hence your initial payment to us acts as your authority for us to make your booking with the Supplier.
We will inform you within 48 hours of placing an order, if, for any reason, in the short time between your payment to us and us seeking to confirm your booking with the Supplier, the Travel Arrangements that you requested for us to book on your behalf become unavailable.
If we cannot obtain an alternative that is acceptable to you, you will of course receive a full refund for the money that you have paid for those Travel Arrangements.
The initial email that is sent with a summary of your order attached is not the contractual acceptance of the Travel Supplier’s ability to provide the requested travel arrangement, this acts purely as an acknowledgement that we have received your order. If all of the Travel Arrangements are available as detailed on our website, then you will be issued with a booking confirmation with the full terms and conditions attached, for both us and the Supplier. Once you have received this booking confirmation and agreed to these Terms and Conditions, then you have entered into a legally binding contract for these Travel Arrangements, subject to both the Supplier’s terms and conditions and our Booking Terms and Conditions.
Further, as an agent we accept no responsibility for the acts or omissions of the Supplier or for the Travel Arrangements provided by the Supplier,
2. Booking
When you make a booking, you will have the opportunity to review/confirm all the details of the booking before making payment. Once you have reviewed and confirmed these details and made payment, we will proceed to make the booking with the Supplier.
Please check that all names, dates and timings are correct on receipt of all documents and advise us of any errors immediately. Any changes to these details will incur the charges stated below. Please ensure that the names given are the same as in the relevant passport. The booking information that you provide to us will be passed on only to the relevant Supplier of your Travel Arrangements or other persons necessary for the provision of your Travel Arrangements. The information may be provided to public authorities such as customs or immigration if required by them, or as required by law. This applies to any special category (sensitive) information that you give to us such as details of any disabilities, or dietary and religious requirements. In making this booking, you consent to this information being passed on to the relevant persons. Certain information may also be passed on to security or credit checking companies. If you are travelling to the United States, the US Customs and Border Protection will receive this information for the purposes of preventing and combating terrorism and other transnational serious crimes. If you travel outside the European Economic Area, controls on data protection may not be as strong as the legal requirements in this country. 3. Payment
In order to book your chosen Travel Arrangements, you must pay a deposit as required by the Supplier of the Travel Arrangements (or full payment if booking within 12 weeks of departure or as requested by the Supplier). You must also pay all applicable insurance premiums and booking fees.
If you have paid a deposit, you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, we will inform the Supplier(s) who may cancel your booking and charge the applicable cancellation fees (as set out in the Supplier’s terms and conditions),and you will also be required to pay a non-refundable administration charge to us of $50 USD per person.
Payment methods that are accepted for new bookings and balances are debit or credit cards. In addition, bank transfers can also be made. Please call 1 (800) 895-9704 for further details. Please use the lead surname and booking reference when making the transfer. If payment is made via this method your payment cannot be tracked unless the Administration Department is notified of the transaction.
Except where otherwise advised or stated in the terms and conditions of the Supplier concerned, all monies you pay to us for Travel Arrangements will be held on behalf of the Supplier concerned, with the exception of bookings covered by an ATOL. Any money paid to us in respect of a booking covered by an ATOL is held by us on behalf of and for the benefit of the Trustees of the Air Travel Trust at all times, but subject to our obligation to pay it to the ATOL Holder for so long as the ATOL Holder does not fail financially. If the ATOL Holder does fail financially, any money held at that time by us or subsequently accepted from the consumer by us, is and continues to be held by us on behalf of and for the benefit of the Trustees of the Air Travel Trust without any obligation to pay that money to the ATOL Holder.
Chargebacks
While you agree not to make any improper chargebacks, in certain cases, you can dispute charges with credit card and other payment facilitation companies ("chargebacks"). Before initiating a chargeback, the traveler must send an email to admin@theweddingtravelcompany.com concerning any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. The Wedding Travel Company retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees, related to improper chargebacks and to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut the chargeback claims below, including without limitation:
- Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
- Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card (this does not include credit card fraud).
- Chargebacks arising from inconsistency or inaccuracy with regard to the Supplier’s product description.
- Chargebacks resulting from force majeure or other circumstances that are beyond the control of us or the Supplier.
- Chargebacks resulting because you do not agree with the cancellation policy.
- Chargebacks resulting because you were not provided with an itemized breakdown of costs in connection with your trip.
- Chargebacks resulting from an experience where you were not satisfied with the services/products provided by travel Supplier.
Installment Payments
On certain applicable bookings you can pay for your Travel Arrangements in installments. We will tell you at the time of booking how many installments there will be, the amount of each installment, and the payment due dates. This will be confirmed by your booking paperwork.
We will endeavor to automatically clear the stipulated funds on the agreed dates as detailed on your paperwork. Please ensure that adequate funds are available on these dates as if the scheduled payment fails for any reason, then the remainder of the payment plan will be void, and our standard terms and conditions will preside, and we will notify you of the new balance due date that we must receive total cleared funds by. If the collecting of an installment was unsuccessful for any reason, then your booking will also be subject to an increased non-refundable administration fee of $30USD which must be paid along with the remaining balance.
Failure to pay on the agreed dates may result in the cancellation of your booking. If you choose to cancel a booking that is subject to installment payments, then additional fees may be payable, in The Wedding Travel Company’s sole discretion. You will be advised of these costs at the time of cancellation.
Should you wish to pay for your Travel Arrangements in part or in full at any time after an installment plan is entered into, then you are entitled to do so, and the remainder of your installment plan will be adjusted accordingly to reflect this.
Important Note: Should you want to make a change to your booking that means that you need to pay a non-refundable amendment fee, then the amendment fee must be paid at the time that you make the change, and this fee cannot be included in your installment payments.
4. Accuracy
We endeavor to ensure that all the information and prices both on our website and in any advertising material that we publish are accurate, however, occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the Travel Arrangements that you wish to book before you make your booking.
5. Prices
We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices.
Special note: changes and errors sometimes occur. You must check the price of your chosen Travel Arrangements at the time of booking.
6. Insurance
Many Suppliers require you to take out travel insurance as a condition of booking with them. In any event, we strongly advise that you take out a policy of insurance in order to cover you and your party against the cost of cancellation by you; the cost of assistance (including repatriation) in the event of accident or illness; loss of baggage and money; and other expenses, as well as ensuring you have cover for any activities you have booked, including additional cover for skiing/extreme sports/adventure travel and all other activities you have booked.
We are not qualified to answer technical questions about the benefits, exclusions, and conditions of travel coverage plans and as such we cannot evaluate the adequacy of the prospective insured's existing insurance coverage. Further, we cannot guarantee that any insurance provider will approve coverage for a claim made under the insurer’s policy and make no representations about the extent of coverage for any policy it may offer or quote. If you have any questions about your travel protection, call your insurer or insurance agent or broker.
Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. We cannot be held responsible for denied entry if a traveler is unable to provide such details to authorities of insurance or denial of entry for any reason. Declining to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred.
IF YOU CHOOSE TO TRAVEL WITHOUT ADEQUATE INSURANCE COVER, NEITHER THE SUPPLIER/PRINCIPAL NOR WE WILL BE LIABLE TO YOU FOR ANY LOSSES HOWSOEVER ARISING, IN RESPECT OF WHICH INSURANCE COVERAGE WOULD OTHERWISE HAVE BEEN AVAILABLE.
7. Special Requests
Any special requests must be advised to us at the time of booking e.g. diet, room location, a particular facility at a hotel etc. You should then confirm your requests in writing. We will pass your request on to the Supplier but we cannot guarantee that they will be fulfilled. The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed on to the Supplier is not confirmation that the request will be met. Failure to meet any special request will not be a breach of contract on neither our part nor the part of the Supplier unless we have specifically confirmed the request.
8. Fitness to Travel and Medical Conditions
We are not a specialist disabled holiday company but we will do our utmost to cater for any special requirements you may have. If you or any member of your party has any medical problem or disability which may affect your trip, please provide us with full details before we confirm your booking so that we can try to advise you as to the suitability of your chosen Travel Arrangements. Further, please note that any accommodations provided outside the US may not be in compliance with the Americans with Disabilities Act (ADA) (e.g., wheelchair accessibility, etc.) and will be at the sole expense of the traveler requiring the accommodation. These Suppliers, may unfortunately, be unable to offer additional assistance to travelers with limited mobility and all such assistance will need to be provided by whoever the traveler is traveling with. Travelers with disabilities must notify us at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. In addition, we may require you to produce a doctor’s certificate certifying that you are fit to participate in your chosen tour.
Acting reasonably, if the Supplier is unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking on the Supplier’s behalf or, if you did not give us full details at the time of booking, we will inform the Supplier who may cancel it and impose applicable cancellation charges, when we become aware of these details.
9. Changes and Cancellations by You
Please note: some Suppliers do not allow changes and therefore full cancellation charges will apply.
Any cancellation or amendment request must be sent to us in writing, by email, and will take effect at the time we receive it. Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that the Supplier will meet such requests. Amendments and cancellations can only be accepted in accordance with the terms and conditions of the Supplier of your Travel Arrangements. The Supplier may charge the cancellation or amendment charges shown in their terms and conditions (which may be as much as 100% of the cost of the Travel Arrangements and will normally increase closer to the date of departure). In addition, you must pay us a non-refundable administration fee of up to £100.00 per person for any amendments to bookings and a non-refundable administration fee of £100 for cancellations or as otherwise set out in the Service Charges table below. We will notify you of the exact charges at the time of amendment or cancellation.
No Refunds for Unused Arrangements
There will not be any refund for any unused portion of a travel booking. While any participant can choose not to participate, please be aware there will be no refunds for any portion of the trip that participant is not able, or chooses not to engage in. Further, if you cancel while your trip is in progress, there is no refund for the unused portion. In addition, if you arrive late to any part of the trip, all costs required to reach and join the activity/trip in progress will be at your own expense.
10. Changes and Cancellations by the Supplier
We will inform you as soon as reasonably possible if the Supplier needs to make a significant change to your confirmed Travel Arrangements or to cancel them. We will also liaise between you and the Supplier in relation to any alternative travel arrangements offered by the Supplier but we will have no further liability to you.
11. Our Service Charges
In certain circumstances we apply a service charge for the agency service we provide, in addition to any charge levied by the Supplier, as follows:

12. Complaints
As the contract for your Travel Arrangements is between you and the Supplier, any queries or concerns about your Travel Arrangements should be addressed to them in the first instance. If you have a problem with your Travel Arrangements whilst using them, this must be reported to the Supplier immediately. If you fail to follow this procedure there will be less opportunity for the Supplier to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.
If you wish to complain when you return home, write to the Supplier. You will see their name and contact details in any confirmation documents we send you.
If you remain unsatisfied, you can inform us, via admin@theweddingtravelcompany.com as soon as possible and, in any event, within 28 days of your return home, whereby we will endeavor to assist in our capacity as an agent by liaising with the Supplier on your behalf. If you wish to complain about any service we have provided to you (i.e. our booking service) then please contact us directly.
13. Our Responsibility for your Booking
The Wedding Travel Company and its members, managers, owners, employees, affiliates, agents, contractors and representatives (“Representatives”) use third party Suppliers to provide Travel Arrangements such as transportation, sightseeing, lodging and accommodations, and all other services related to this trip. The Wedding Travel Company is an independent contractor and is not a Representative of any of these Suppliers. The Wedding Travel Company does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurant, or any other entity that supplies services related to your trip. All Suppliers are independent contractors and are not Representatives of The Wedding Travel Company All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each Supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all travelers agree that neither The Wedding Travel Company, nor its Representatives are or may be liable for any loss, injury, or damage to any trip traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of The Wedding Travel Company including in the event any third-party providers or healthcare professionals seek to assist with medical or other help and we are not liable for any costs or missed activities in relation to said assistance. The Wedding Travel Company assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveler that may result from any act or omission on the part of others; The Wedding Travel Company assumes no responsibility or liability for personal property; and The Wedding Travel Company shall be entirely relieved of any obligations under these Terms and Conditions in the event of any force majeure. The Wedding Travel Company accepts no responsibility for lost or stolen items. Further, The Wedding Travel Company reserves the right to refuse any customer or potential customer at its sole discretion.
14. Events Beyond Our Control (Force Majeure)
Except where otherwise expressly stated in these Booking Terms and Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by force majeure events or “Events Beyond Our Control”. For the purposes of these Booking Terms and Conditions, Events Beyond Our Control means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. We assume no liability for these events such as an Act of God or any other unforeseen condition, including, without limitation: natural, nuclear, chemical or biological disasters, fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, or any other acts of a similar nature, sabotage, cybersecurity issues and/or technology outages or disruptions, changes of schedules or operational decisions of air carriers, arrests, strikes or labor disruptions, lock closure, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics (including, without limitation, COVID-19), or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel Supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by us that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions.
Brexit Implications: please note that certain Travel Arrangements may be affected as a result of the United Kingdom’s decision to leave the European Union. This could include an unavailability of certain flight routes, access to certain ports and airports and changes to the visa requirements of British citizens travelling to, within or through the EU. Please rest assured that this is something we will continue to monitor and will advise our customers as soon as possible if we become aware of any confirmed bookings that will be affected. However, since this is something which is completely unprecedented and outside our control, we would treat any such changes as Events Beyond Our Control, and whilst we will endeavor to provide suitable alternative arrangements or refunds where possible, we will not be liable to pay you any compensation.
15. Indemnification
Traveler agrees to and shall indemnify and hold harmless The Wedding Travel Company and its Representatives from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by us or our Representatives (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) your breach or violation, or threatened breach or violation, of these Booking Terms and Conditions; (ii) any of your acts or omissions, including any damage caused by you to persons or property while participating in the trip, (iii) any force majeure or events beyond our control or inherent risk of travel; or (iv) claims brought by third parties in connection with any of the foregoing. The terms of this INDEMNIFICATION paragraph shall survive any termination or cancellation of these Booking Terms and Conditions, whether by operation of law or otherwise.
16. Assumption of Risk
Traveler is fully aware of the inherent risks connected with participating in the trip. These risks include, but are not limited to, risk of injury or death from: force majeure, motor and conveyance vehicle collisions, water related activities, animals, roadway hazards, slips, and falls, uneven terrain, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; seasickness, your own negligence and/or the negligence of others, including tour guides, other travelers, The Wedding Travel Company and its Representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; foodborne illnesses, dietary restrictions or allergic reactions, fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, illnesses caused by COVID-19 (or other pandemics and infectious diseases, etc.), physical exertion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; equipment malfunctions; or a lack of safety features and/or failure to utilize any safety features.
FURTHER, Traveler hereby accepts and assumes full responsibility for any and all risks and agrees to and shall hold harmless and fully release The Wedding Travel Company and its Representatives from any and all claims associated with the trip, including any claims of third party negligence and/or the negligence of The Wedding Travel Company and/or its Representatives and traveler hereby covenant not to sue The Wedding Travel Company and/or its Representatives for any such claims or join any lawsuit or action that is suing The Wedding Travel Company. These Booking Terms and Conditions also bind your heirs, legal representatives and assigns. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of these Booking Terms and Conditions, whether by operation of law or otherwise.
17. Visa, Passport and Health Requirements
Travel to certain destinations may involve greater risk than others. The Wedding Travel Company urges travelers to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at https://travel.state.gov/content/travel.html, and http://www.cdc.gov. In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country, including COVID- 19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. A U.S. State Department list of travel advisories is available at https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories.html/. Should you choose to travel to a country that has been issued a travel warning or advisory, The Wedding Travel Company will not be liable for damages or losses that result from travel to such destinations.
Travelers are solely responsible for obtaining and maintaining all required passports, visas, entry permits, inoculations and other required documents, and travel authorizations, including but not limited to ETIAS (European Travel Information and Authorization System), UK ETA (Electronic Travel Authorization), and any similar government-mandated authorization programs, and for complying with all entry, transit, and exit requirements of the countries visited. When travelling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here: http://www.tsa.gov/traveler-information/acceptable-ids. Air travelers with identification (ID) that does not meet the REAL ID ACT requirements will have to use alternate ID forms (passport, military ID, or permanent resident card) to pass TSA security checkpoints—even for domestic travel. Visas are required when they apply. You can find out if your international destination requires a visa at https://www.usa.gov/visas-citizens-traveling-abroad. Travelers voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/ exit fees which will be collected at the airports upon entry/departure by local government authorities. The Wedding Travel Company strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Many countries require a minimum number of blank pages in your passport book. Non-USA citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. Further, the U.S. Customs and Border Protection Agency require that for groups of children under age 19 arriving to the United States by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/. Further, certain countries restrict travelers with criminal convictions, even if expunged. Please inform us prior to booking with us if this applies to you and seek separate legal counsel to confirm your ability to travel to your desired destination. If you are denied access to a country or a Supplier due to a conviction, The Wedding Travel Company shall not be liable for any losses, expenses, or refunds to you or anyone in your group.
In addition, recommended inoculations and vaccinations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations and vaccinations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/.
YOU ACKNOWLEDGE ANY FAILURE TO STRICTLY COMPLY WITH THESE REQUIREMENTS MAY RESULT IN DENIED BOARDING OR AN UNDUE DELAY AT AN AIRPORT SECURITY CHECKPOINT CAUSING TRAVELER TO MISS FLIGHT(S), AND SUBSEQUENT SCHEDULED TRAVEL BOOKINGS TRIPS. THE WEDDING TRAVEL COMPANY BEARS NO RESPONSIBILITY FOR ADVISING AND/OR OBTAINING REQUIRED TRAVEL DOCUMENTATION FOR YOU, OR FOR ANY DELAYS, DAMAGES, AND/OR LOSSES INCLUDING MISSED PORTIONS OF YOUR VACATION RELATED TO IMPROPER DOCUMENTATION OR GOVERNMENT DECISIONS ABOUT ENTRY.
18. Law and Jurisdiction
These Booking Terms and Conditions are governed by English law and we both agree that the courts of England and Wales have exclusive jurisdiction over any dispute, claim or other matter which may arise between us (unless you live in Scotland or Northern Ireland, in which case you can bring proceedings in your local court under Scottish or Northern Irish law, as applicable).
19. Class Action Waiver and Limitation of Damages
YOU AGREE THAT YOU WILL ONLY BRING CLAIMS AGAINST THE WEDDING TRAVEL COMPANY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. THE WEDDING TRAVEL COMPANY SHALL NOT IN ANY CASE BE LIABLE FOR OTHER THAN COMPENSATORY DAMAGES, AND YOUR PAYMENT OF A DEPOSIT ON A TRIP MEANS THAT YOU AGREE TO THESE CONDITIONS OF SALE AND EXPRESSLY WAIVE ANY RIGHT TO PUNITIVE DAMAGES. YOU FURTHER AGREE THAT IN NO EVENT SHALL THE WEDDING TRAVEL COMPANY’ LIABILITY TO YOU (OR ANY MEMBER OF YOUR TRAVELING PARTY, OR YOUR/THEIR HEIRS, SUCCESSORS AND ASSIGNS), FROM ANY CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, INDEMNITY, EQUITY, OR OTHERWISE), EXCEED TWICE THE COST OF THE COMMISSION WE EARN ON YOUR BOOKING (OR THE APPROPRIATE PROPORTION OF THIS IF NOT EVERYONE ON THE BOOKING IS AFFECTED). FOR THE SERVICES THE WEDDING TRAVEL COMPANY PERFORMED AND PROVIDED TO YOU IN CONNECTION WITH THESE TERMS AND CONDITIONS, AND THIS IS YOUR SOLE AND EXCLUSIVE REMEDY FOR A BREACH OF THESE TERMS AND CONDITIONS BY THE WEDDING TRAVEL COMPANY.
YOU HEREBY AGREE TO WAIVE YOUR RIGHT TO TRIAL BY JURY. YOU UNDERSTAND AND AGREE THAT NO CLAIMS WILL BE CONSIDERED AND THAT YOU WILL NOT BRING SUIT AGAINST THE WEDDING TRAVEL COMPANY UNLESS YOU HAVE FIRST PROVIDED A WRITTEN NOTICE OF CLAIM TO THE WEDDING TRAVEL COMPANY WITHIN THIRTY (30) DAYS AFTER THE TRIP OR CANCELLATION OF THE TRIP, FURTHER PROVIDED THAT YOU AGREE TO FILE SUIT WITHIN ONE (1) YEAR OF THE INCIDENT AND YOU ACKNOWLEDGE THAT THIS EXPRESSLY LIMITS THE APPLICABLE STATUTE OF LIMITATIONS TO ONE (1) YEAR
20. Entire Agreement & Severability
These Booking Terms and Conditions, including the terms and conditions of our Suppliers, and any other documents, including invoices, that we provide you constitutes the entire agreement, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to the Wedding Travel Company. If any provision of these Booking Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. Failure by us to exercise or enforce any right or provision of these legally binding Booking Terms and Conditions shall not constitute a waiver of such right or provision.
21. Accommodation Ratings and Standards
All ratings are as provided by the relevant Supplier. These are intended to give a guide to the services and facilities you should expect from your accommodation. Standards and ratings may vary between countries, as well as between Suppliers. We cannot guarantee the accuracy of any ratings given.
22. Documentation & Information
All descriptions and content on our website or otherwise issued by us is done so on behalf of the Supplier in question are intended to present a general idea of the services provided by the Supplier. Not all details of the relevant services can be included on our website. All services shown are subject to availability. 23. Your Behavior
Each traveler in any trip planned by us is expected to act responsibly and adhere to all applicable local and national laws, regulations and policies, including the use and/or possession of illegal substances at the location of your travel (e.g., marijuana), and behavior guidelines established by our Suppliers/Principals. You are expected to conduct yourself in an orderly and acceptable manner and not to disrupt the enjoyment of others. If in the Supplier’s opinion or in the opinion of any other person in authority, your behavior or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any other customers or any third party, or damage to property, or to cause a delay or diversion to transportation, the Supplier reserves the right to terminate your booking immediately with no further liability to you. You and/or your party may also be required to pay for loss and/or damage caused by your actions and you and each member of your party will be jointly and individually liable for any damage or losses caused. Full payment for any such damage or losses must be paid directly to the Supplier prior to departure. If you fail to make payment, you will be responsible for meeting any claims (including legal costs) subsequently made against us because of your actions together with all costs we incur in pursuing any claim against you. Further, you must indemnify us for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip, or any portion of a trip including your costs to return home. You further agree not to hold us or any of our representatives liable for any actions taken under these Booking Terms and Conditions.
We cannot be held responsible for the actions or behavior of other guests or individuals who have no connection with your booking arrangements or with us.
24. Delays, Missed Transport Arrangements and other Travel Information
DISCLAIMER. Your contract for airfare is with the air carrier, inclusive of domestic, international and charter flights, and subject to its terms, conditions and policies and we will not be liable for any fees or expenses, including without limitation, change fees, cancellation fees or any other additional costs you incur with the air carrier. For charter trips/flights, please be aware the charter operator can legally change, with limited notice, departure times up to forty-eight (48) hours, and flights advertised as non-stop may be changed to make intermediate stops. Suppliers can substitute types of aircraft and even airlines and are generally not responsible for baggage delays/losses and have very stiff cancellation penalties. In addition, frequent flyer miles may or may not be accrued and advance seat assignments are frequently not available. We are not responsible or liable for any costs incurred with any changes resulting from any flights and/or missed transport arrangements. As mentioned previously, please review documents carefully and promptly as we will not be responsible for any errors. Travelers voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation.
Baggage Fees/Information. Baggage and personal effects are at all times the sole responsibility of the traveler. Due to continual changes in airline baggage and seat selection policies, it is suggested that you inquire with your airline's website for up-to-date fees & information. The Wedding Travel Company is NOT responsible for additional fees incurred for baggage and/or seating assignments. The Department of Transportation along with the Federal Aviation Administration outline which materials are hazardous to carry in your baggage. Re-confirm Your Flight. The Wedding Travel Company advises you personally to re-confirm your flight schedule within twenty-four (24) hours prior to departure directly with the airline in case of any last-minute changes or delays. Most airlines allow you to check in online twenty-four (24) hours prior to departure. It is recommended that you arrive at the airport a minimum of two (2) hours prior to departure for domestic flights, and three (3) hours for international flights. We are not responsible for any costs incurred due to delayed or missed flights.
Hazardous Materials. Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. Examples include Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radioactive materials. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. Insecticide Notice. Travelers are encouraged to check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the U.S. Department of Transportation’s website, as this list is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.
25. Cruise Bookings
It is the customer’s responsibility to settle all of their on board accounts. Children under the age of 18 will not be carried unless accompanied by an adult over the age of 21 at the time of boarding, who accepts responsibility for their welfare, conduct and behavior. Infants younger than 6 months at point of boarding may not be accepted on some ships, full details are provided at booking stage and we accept no liability for incorrect information that may have been provided by you.
